Terms of Service

Welcome to Growfer.

These Terms of Service (“Terms”) govern your access to and use of Growfer (the “Service”), operated by Peakweb Inc.(“Peakweb,” “we,” “our,” or “us”).

By accessing or using the Service, creating an account, or purchasing any Growfer offering, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

You must be at least 18 years old and capable of entering into a legally binding agreement to use the Service.

If you use Growfer on behalf of a company or other organization, you represent that you have authority to bind that organization to these Terms.

Growfer helps businesses understand and improve how they are represented across AI-powered search engines, answer engines, and large language models.

Depending on the offering you purchase or use, the Service may include:

• AI visibility audits
• Website analysis
• Technical SEO and GEO analysis
• Performance analysis
• Competitor comparisons
• Prioritized recommendations
• Monitoring and reporting
• Other AI-powered business insights

We may add, modify, or discontinue features at any time.

Certain features require an account.

You are responsible for:

• Maintaining the security of your account
• Keeping your account information accurate
• All activity occurring under your account

Authentication services are provided through WorkOS.

Notify us immediately if you believe your account has been compromised.

You agree to use Growfer lawfully and responsibly.

You may not:

• Submit information you do not have the right to use
• Attempt to interfere with or disrupt the Service
• Circumvent security measures or rate limits
• Reverse engineer, copy, or reproduce the Service or its underlying technology
• Use automated systems to abuse the Service
• Resell, sublicense, or commercially exploit the Service without our written permission
• Use Growfer to develop or operate a substantially similar competing service using our proprietary methods or materials
• Use the Service in violation of applicable laws or regulations

We reserve the right to suspend or terminate accounts engaged in prohibited activity.

Some Growfer features require payment.

Pricing is displayed at the time of purchase.

Unless otherwise stated:

• One-time audits are billed once.
• Monitoring and other recurring services, if offered, renew automatically until canceled.
• Payments are securely processed by Stripe.
• We do not store your payment card information.

Because audit generation begins shortly after an order is placed and consumes third-party computing resources, completed audits are generally non-refundable.

If you believe you were charged in error or experienced a technical issue, please contact us at legal@peakweb.io.

You retain ownership of the information you submit to Growfer, including website URLs, business information, and related materials.

You grant Peakweb a limited license to use that information solely for the purpose of providing and improving the Service.

You represent that you have the necessary rights to submit any information provided through the Service.

Growfer, including its software, branding, designs, scoring methodology, audit framework, reports, and underlying technology, is protected by intellectual property laws.

Except for the rights expressly granted in these Terms, no ownership or intellectual property rights are transferred to you.

You may use audit reports generated for your business for internal business purposes.

You may publicly share your own audit reports provided they are not modified in a misleading way and do not imply endorsement by Peakweb.

Growfer uses artificial intelligence to generate analyses, scores, summaries, and recommendations.

AI systems are probabilistic and may occasionally produce incomplete, outdated, or inaccurate information.

Growfer’s reports are provided for informational purposes only and should not be relied upon as legal, financial, accounting, marketing, or other professional advice.

You are responsible for evaluating and implementing any recommendations.

We do not guarantee any particular search ranking, AI visibility, business outcome, traffic increase, revenue increase, or competitive advantage.

We strive to provide a reliable service but do not guarantee uninterrupted availability.

The Service may occasionally be unavailable due to maintenance, infrastructure outages, software updates, security events, or circumstances beyond our reasonable control.

To the fullest extent permitted by law, Growfer is provided “AS IS” and “AS AVAILABLE.”

Peakweb disclaims all warranties, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy.

To the maximum extent permitted by applicable law, Peakweb and its officers, directors, employees, contractors, and affiliates shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or relating to your use of the Service.

Our total liability for any claim relating to the Service shall not exceed the greater of:

• the amount you paid to Peakweb during the twelve (12) months preceding the event giving rise to the claim; or
• one hundred U.S. dollars (US$100).

Some jurisdictions do not permit certain limitations of liability, so portions of this section may not apply to you.

You agree to defend, indemnify, and hold harmless Peakweb Inc., its officers, employees, contractors, and affiliates from claims, damages, liabilities, costs, and expenses arising from:

• your use of the Service;
• your violation of these Terms; or
• your violation of any law or the rights of another person.

You may stop using the Service at any time.

We may suspend or terminate your access immediately if:

• you violate these Terms;
• you misuse the Service;
• payment obligations are not met; or
• continued access would create legal or security risks.

Termination does not affect obligations that, by their nature, survive termination.

Your use of Growfer is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

These Terms are governed by the laws of the State of Colorado, without regard to its conflict of law principles.

Any legal action arising from these Terms or the Service shall be brought exclusively in the state or federal courts located in Colorado, and you consent to the jurisdiction of those courts.

We may update these Terms from time to time.

If we make material changes, we will provide reasonable notice through the Service or by email before the updated Terms become effective.

Your continued use of Growfer after the effective date constitutes acceptance of the revised Terms.
